中央勾勒未来城市社区图谱 中国不再建封闭小区-搜狐财经   本报记者 纪睿坤 北京报道  2月21日,新华社全文刊发了《中共中央 国务院关于进一步加强城市规划建设管理工作的若干意见》全文(下称“意见”),这份长达8000字的长文,是时隔37年重启的中央城市工作会议的首份配套文件。  据21世纪经济报道记者采访获悉,该份文 相关公司股票走势 件是住建部会同29个部门在深入调研和认真总结经验基础上起草而成,部署了一个个破解城市发展难题的“实招”,并列出了时间表。  住建部部长陈政高称,该文件是当前和今后一个时期指导城市规划建设管理、促进城市持续健康发展的纲领性文件。  意见首度勾勒了未来城市居住社区的蓝图。意见明确,要转变封闭式住宅小区为街区开发制;造方便快捷生活圈、城市公园原则上要免费向居民开放等;树立“窄马路、密路网”的城市道路布局理念;实现中心城区公交站点500米内全覆盖等等。  其中,未来城市社区图谱中,取消封闭式住宅小区因为涉及7.5亿城市居民的直接利益,引发关注。这也是我国历史上第一次明确建设开放式小区的文件。  “意见是一个方向性的纲要,具体的落地执行细则还未出台,出发点是希望通过建立更开放的社区,打通城市内循环,方便缓解交通的拥堵,实行公共资源的共享。”2月22日,彩生活总裁唐学斌告诉21世纪经济报道记者,政策的立意很好,但在后期执行时应因城因盘施策,切忌一刀切。  开放式小区存落地难题  和其他未来城市社区的图谱方案相比,意见中“不再建设封闭式小区,已建成的住宅小区和单位大院要逐步打开”无疑是关注最大的一条。  “建国以来,很多城市社区结构都是大院组成,他们占了很大的面积,1998年的福利分房后,封闭式的商品房小区也大都沿用封闭式社区的规划模式,短期内很难改观。”中国建筑标准设计研究院顾问、总规划师韩秀琦如是表示。  谈及由封闭式转向开放式街区铺开的问题,产权归属的梳理和物业和社区管理的细化,成为落地关键。  唐学斌也告诉21世纪经济报道记者,从落地执行上来看,的确面临一些挑战。  根据《物权法》第七十三条,建筑区划内的道路,属于业主共有,但属于城镇公共道路的除外。  2016年刚开始发布执行的《不动产登记实施细则》第三十六条也明确,建筑区域内依法属于业主共有的道路、绿地、其他公共场所、公用设施和物业服务用房及其占用范围内的建设用地使用权一并申请登记为业主共有。  亚豪机构市场总监郭毅称,按照现行的法律规定,如果打开已建成的住宅小区,实现内部道路公共化的前提,需争取全体业主同意,且政府需要给予业主一定的补偿款。  另外,唐学斌也表示,小区内的道路和公共设施水平差异,直接影响房价水平,且已经由业主买单,如果把封闭式小区配套设施打通给小区外业主,如何协调各方利益也是落地的关键问题。  剔除产权归属争议,由封闭转化为开放式街区也面临物业管理、社区公共资源被挤占,等问题。  一方面,部分人担心小区变成街区之后,缺乏对游商小贩的足够管理,会造成小区环境的恶化;另一方面,在原本小区内公共资源不富裕的情况下,外来车辆与人员对公共绿地、车位等资源的挤压,小区管理和环境恶化的下一步便是房价的下跌。  开放式小区并非新概念,京津亦不乏开放式小区的个案,不过,据21世纪经济报道记者采访了解亦发现,相比封闭式小区,开放式小区普遍存在社区管理问题,诸如“牛皮癣”广告、摊贩等问题,和周边的居住产品相比,价格上涨慢。  安徽省一位地级市的住建委副主任告诉21世纪经济报道记者,从执行角度来看,因不涉及业主争议,新建城区更容易落地执行。  郭毅也提出,一旦新建城区的封闭式小区转成街道式小区,一个直接的变化是房地产普遍存在的地段和资源论调,将开始转换。  切忌“一刀切”  “意见只是提出了一个方向。”唐学斌表示,后续或将会有更多配套性细则的出台。  在唐学斌看来,考虑到现实情况,唐学斌认为,需要因地因盘施策。  从城市大系统的角度出发,开放式街区模式肯定好于封闭式小区,住建部相关人士亦表示,封闭小区的一个个楼盘都是一个个独立王国,彼此不关联,公共服务设施不共享。但现代城市应该是开放的,以公共服务、公共空间作为特征。由封闭转向开放,可以增加建成区的路网密度,解决交通拥堵,盘活土地资源。  根据意见,到2020年,城市建成区平均路网密度提高到8公里 平方公里,道路面积率达到15%。  中国城市规划设计研究院副院长杨保军即表示,道路面积率是道路面积占整个城市的比率。目前我国这一指标在12%左右。开放式小区可以促进城市内部的交通循环,增加建成区的路网密度。  “政策立意很好,但也需要考虑现实问题。”唐学斌介绍,中国的建筑密度较高,全部建成欧美国家开放式小区的模式,会有难度,不少的社区开放以后,,可能存在负面效果。  “很多高层临街的小区,实际上已经是很集约的土地管理了,把中间挖出来,设计为这些高层业主的活动区域,如果打通,这些业主的外部活动需求不会少,从小区内部转向小区外,不仅不会解决交通问题,更会加剧。”唐学斌如是介绍。  另外,唐学斌介绍,不少小区车满为患,可能内部车辆就已经很难满足小区内业主需求,如果新增外部车辆,将加剧小区内的停车、行车矛盾。  北京荣邦瑞明总经理陈民告诉21世纪经济报道记者,对于未来城市社区来说,变封闭为开放,可以加深人与城市的联动,促进城市内循环。但不同小区的周边环境、小区内公共道路的产权归属尚不明确,需因地因盘施策,不能一刀切。如果道路属于业主所有,更应该遵循业主的意见。  作者:纪睿坤相关的主题文章:
